According to the motion, time and material costs could be as high as $130,000 for work by the Native Hawaiian Legal Corporation.
The filing said the client, plaintiff Paulette Kaleikini, has no contractual obligation to pay.
If the court were to award costs only for the appeal phase, the motion says the total would be $55,000.
A spokesperson for HART said the city is reviewing the motion and will be filing an appropriate response.
The city did not yet have a tally of what it has spent so far on rail-related lawsuits.
Earlier this year, the Honolulu City Council passed a motion raising to $1million that authorized amount for outside counsel in this case and a federal case.
