Brennan’s attorney does not believe the police officer who pulled over the former University of Hawaii Warriors quarterback had reasonable suspicion.
The first thing Brennan’s attorney did was raise questions about the credibility of the HPD officer who initiated the DUI stop back in July.
Last year, Officer Michael Krekel stood trial for tampering with government documents in a police DUI road block overtime abuse case. He was found not guilty by a jury.
Thursday’s driver license revocation hearing for Brennan got testy at times.
Officer Krekel said Brennan was speeding moments before he was pulled over, and while at the traffic light fronting Castle Medical Center he chirped his siren in an effort to tell Brennan to slow down, but the officer said Brennan didn’t respond, which is one of many reasons to have reasonable suspicion of drunk driving.
"Two of them are the individual does not respond to an officer’s response, signal, siren. The second one is not responding to traffic lights in a timely manner," Krekel said.
Brennan was not required to attend Thursday’s hearing.
The former Heisman Trophy finalist has already had his license suspended for the year, but his attorney doesn’t believe there was enough reason to pull his client over.
"I don’t think there is a sufficient, factual basis to substantiate the reasonable suspicion in this case. And because there is no reasonable suspicion I believe that the revocation must fail," attorney George Burke said.
A decision on whether the suspension continues or is thrown out will be made in the next five days.
Separate court proceedings are scheduled next month on the criminal aspects of the DUI charge.
