Company files appeal with state over rail contract dispute

One of the companies that lost out on a lucrative rail contract is filing an appeal with the state.

Bombardier says it had the best value proposal for the core systems contract, but says it was improperly disqualified.

Last week, the city rejected Bombardier’s protest, saying the bid came with conditions.

So the company is asking the state to step in.

"In this way, we are confident that we will get an independent and fair hearing in front of an impartial administrative judge," said Bombardier vice president Andrew Robbins.

The State Department of Commerce and Consumer Affairs will hold a hearing within three weeks and make a decision within 45 days.

The city had not received a copy of the appeal, but said they consider it a continuation of the protest process.
