Losing rail contract bidder may appeal decision in court

One of the two companies that lost out on a lucrative rail contract says it may appeal in court.

In March, the contract for the rail cars and core systems was awarded to Ansaldo Honolulu.

Bombardier protested to the city and then took its case to the state commerce department, which upheld the city’s decision to disqualify Bombardier’s bid.

Now Bombardier has a 10-day period to appeal to the Circuit Court and says it will seriously consider it.

Bombardier says it had the lowest bid "…and should have been given every consideration even if the city felt there was a flaw in the proposal."

Meanwhile the State Commerce Department is expected to weigh in on the appeal of another losing bidder, Sumitomo, by next week.
