A manslaughter charge has been dismissed for a boater accused of killing a diver off Lanai.
Eric Olbrich had been charged with manslaughter and reckless operation of a vessel.
Authorities say in July 2011 he was operating a tour boat outside of Kaumalapau harbor on Lanai.
When he struck and killed Alan Amoncio, a free diver who had set up flags and floaters to alert boaters to his position.
The judge dismissed the charges without prejudice, which means the state could re-file charges at a later date.
