Kokua Line: Does law treat electric foot scooters same as e-bikes?

Question: I saw a child riding what appeared to be an electric foot scooter on the bike lane on Kalanianaole Highway. It was motorized but quiet so I assume electric. No one with the child, who appeared age 12 at most. Is this legal now?
